Terms of Service

These terms govern your use of MergeSafe, an automated code review service for GitHub pull requests, including the website at mergesafe.ai, the MergeSafe app and the MergeSafe GitHub App and integrations (together, the “Service”). By signing in with GitHub, installing the GitHub App or an integration, or otherwise using the Service, you agree to them. If you do so for an organization, you confirm you are authorized to accept these terms for it.

Who we are

The Service is provided by Z Squared Technologies LLC, 31560 Crabtree Lane, Solon, Ohio 44139, United States (“we”, “us”), doing business as MergeSafe. Questions about these terms: legal@mergesafe.ai.

Your account

• You must be at least 18 years old.
• Sign-in is through GitHub. Keep your GitHub credentials secure; you are responsible for activity under your account and for the organizations you install the Service on.
• Organizations have an Admin who manages members, spending limits and billing in the app.

What the Service does, and what it does not

MergeSafe reads pull requests and posts review findings. Findings are advisory. They can be incorrect or incomplete, and a review is not a guarantee that code is correct, secure or safe to merge. You remain responsible for what you review, approve and merge.

Acceptable use

You agree not to:

• use the Service unlawfully, or on code or content you have no right to submit;
• abuse the Service or run up cost on it through automated or artificial means;
• share your credentials or let people outside your organization use your account;
• reverse engineer the Service, or probe or attack it other than through our disclosure process;
• submit illegal content, or content that infringes the rights of others.

Your code and data

You keep all rights in your code. You give us permission to process it only to provide the Service to you. What we collect, how long we keep it and how to have it deleted are described in our Privacy page and on Security and data retention. In summary:

• Data derived from your code, such as the repository index, expires 30 days after the repository or pull request was last active (an actively reviewed repository keeps its index while in use), is encrypted per repository, and is deleted straight away, with its key, when you remove the repository or uninstall. Cross-repository claim summaries do not yet expire on that schedule but are still deleted on uninstall.
• Your code is processed by the subprocessors listed on our Subprocessors page, including AI model providers. We may add providers as the Service grows and keep that page current.

Credits, payment and refunds

• The Service is paid for with prepaid credits, bought through Stripe. Prices are shown in the app. Unless stated otherwise they exclude taxes, which we collect where required.
• Credits never expire. Promotional credit is spent before paid credit.
• Failed reviews are never charged.
• You may ask for a refund of 95% of your unused paid credit within 30 days of first installing the Service. The remaining 5% covers payment processing fees.
• Spending limits you set in the app apply to your organization.

Suspension and termination

You can stop using the Service at any time by uninstalling it. We may suspend or end access if you break these terms or put the Service or others at risk.

Our intellectual property

The Service, its software and its brand belong to us and our licensors. You may use the Service as these terms allow; nothing else is licensed to you.

Availability and warranties

We work to keep the Service available but do not promise it will be uninterrupted or error free. To the extent the law allows, the Service is provided “as is” and we disclaim implied warranties.

Limit of liability

To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or lost profits, and each party’s total liability arising from the Service is limited to the amounts you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

Changes to these terms

We will give 15 days’ notice by email and in the app before a material change takes effect. If you do not accept a change, you may stop using the Service and ask for a refund of 95% of your unused paid credit.

Governing law

These terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-law rules. Before starting any claim, please write to legal@mergesafe.ai so we can try to resolve it.
